Aide sentenced for molesting patient

ANDERSON, Ind. -- A former aide at a mental health center was sentenced to 20 years in prison for felony child molestation after admitting he had sex with a 13-year-old patient.

Madison Circuit Court Judge Fredrick Spencer on Monday ordered 27-year-old Elzie K. Harty, of Muncie, to serve 30 years with 10 years suspended as part of a plea agreement. Harty pleaded guilty in February to having sex with the girl between April 2005 and April 2006.

Harty's attorney, Dylan A. Vigh, said his client understands that he used poor judgment and is willing to accept the punishment.

Harty had worked as a therapist assistant at the center, which provides adolescent residential treatment for those ages 11 through 18 with emotional and behavioral difficulties.

Anderson police say the teen's counselor turned over handwritten notes between her and Harty to Madison County Child Protective Services, which then contacted the police. The teen told investigators that she and Harty had sex in her room at the center about 10 times while he was conducting room checks. They reportedly had sex at Harty's Muncie home when the girl would get weekend passes.

Harty was also sentenced to 10 years in prison in Delaware County for charges relating to the same victim. The two prison sentences will run at the same time, Vigh said.
